The conclusion of the Legal Department of the Chancellery of the Seimas regarding the project of direct management of the LFF has reached the Lithuanian Football Federation (LFF).
The conclusion of the legal department of the chancellery of the Seimas indicates that the law on the project of direct management of the LFF would be contrary to the Constitution and the principle of the rule of law.
“Considering the above, it can be assumed that a legal settlement is proposed, according to which, after the entry into force of the law, the governing bodies of the sports association operating in Lithuania – the Lithuanian Football Federation – would lose their powers, and their functions would be taken over by a provisional administrator appointed by the Ministry of Education, Science and Sports, who would initiate the modification of the statutes of the association and the election of new governing bodies, contrary to articles 5 and 35 of the Constitution and the principle of the rule of law“, – is announced in the conclusion of the Legal Department of the Chancellery of the Seimas regarding the law on the direct management of the LFF.
Representatives of FIFA and UEFA are expected
Chairman of the Seimas National Security and Defense Committee, Laurynas Kasčiūnas, claimed on Thursday that Seimas members, such as Prime Minister Ingrida Šimonytė, had received a letter from the LFF regarding planned visits by representatives of the FIFA and UEFA in the country.
Although LFF Premier Ingrida Šimonytė says she has yet to receive a response to her formal appeal to FIFA and UEFA leaders regarding the situation, according to her, the country’s football officials themselves provided him with information on the planned visits. representatives of these international organizations in Lithuania.
According to the Prime Minister, the adoption of the law on the direct management of the LFF, which has already been registered in the Seimas, would be the last step that the politicians would take in case the federation does not take the required decisions on its own .
“If he fails to do so, or if the process gets stuck, then apparently the Seimas will have no other way out, how to use this ultima ratio decision,” said I. Šimonytė.
The issue of the direct management of the LFF was raised by politicians at the joint meeting of the Seimas Budget and Finance Committee and the Youth and Sports Committee held at the end of July, in attended by representatives of the LFF.
In the opinion of international football organizations, of which the Lithuanian Football Federation is a member, the adoption of a direct law by the LFF is a violation of the provisions of the statutes of FIFA and UEFA, for which football Lithuanian is threatened with direct consequences: suspension of the participation of national teams and clubs in tournaments organized by FIFA and UEFA, end of financial assistance to Lithuanian football.
However, it was announced on Tuesday that the LFF’s special working group had decided to submit a draft statute change to the LFF’s highest governing body – the general members’ conference.
However, after the announcement of the draft amendment to the statutes of the federation, the members of the Seimas remained strict – the fate of the law on the direct management of the LFF depends on the full implementation of the provisions contained therein.
Seimas member Mr Majauskas has claimed that the LFF’s compromise decisions will not restore public confidence. He was also backed by L. Kasčiūnas, who said LFF’s decisions do not mean politicians will sit idly by.
On Thursday, the Law and Order Committee of the Seimas (TTK) decided that the draft temporary law “On Direct Management of the Lithuanian Football Federation” currently has too many inconsistencies with the country’s Constitution and has postponed consideration of the issue until Tuesday, after the law’s drafters improved the draft.
Such a decision by the TTC prevented consideration of the bill in the plenary session of the Seimas at the submission stage.
