Congress takes the first step to abolish the crime of sedition

A large majority of Congress voted this Thursday to reform the penal code, which would replace the crime of sedition with aggravated public disorder, to begin the parliamentary process with 187 votes to 155, with six abstentions. The plenary session to consider the proposal went off without a hitch, although the PP appealed the voting format to force each MP to speak out loud.

In the eternal plenary session, which began at 9 am with a budget debate and continued into the afternoon with the processing of bills on banks and electricity companies, the agenda for the cancellation of the rebellion was night owls and hustle and bustle. Interruptions with the spokesmen of PSOE and Unidas Podemos from the right-wing bench were constant, with an intense exchange of reprimands between the government and the opposition from the speaker’s rostrum.

“You, on your offense. Leave the politics to us. With confrontation with you and the past, coexistence with us and the future”, – Socialist MP Francisco Aranda opened the debate. He was followed by Jaume Assens, an MP from United We Can, with a second group reform proposal. “It is a relic of the past, full of dust from a world that no longer exists. This is a pre-constitutional anomaly, the rule of law will not allow such a crime,” he defended.

The PP decided that the person responsible for defending its position against reform would be its speaker, Cuca Gamarra, who described the end of the rebellion as a “disgraceful initiative” that, in his opinion, serves only one purpose: “It is the end of what happened in Catalonia from September to October 2017 Erasure. Pardon, sedition, appropriation. The goal is amnesty and self-determination. This is a tailor-made suit for rebels. No one has ever dared to do so much,” he said.

For his part, the ERC’s spokesman in Congress, Gabriel Ruffian, said that the reform “is not a concession to the ERC, it is not a concession to the independence movement. Moreover: I wish there were. This is a concession to democracy. It’s a concession to their democracy so they can stop fooling around in Europe,” he said before weighing the weight of his group in the legislature: “Nine people are sleeping in a house and not in a cell thanks to our vote. And we took away the toys from the fascist judges. We are not responsible for PSOE’s decisions, but for its corrections. ”

The reform of the Criminal Code, which today begins to be processed, is actually a specification of certain commitments by the PSOE and the ERC at the dialogue table, the so-called Sánchez and Aragonés have been working for months on the measure, which the president of the government himself confirmed just two weeks ago on the grounds that his executive is working to solve the problem he inherited from the PP with Catalonia. “We are building coexistence. The president of the Generalitat, Pere Aragonés, defended the replacement of the crime of rebellion with the crime of aggravated public disorder, describing it as “an essential step in the removal of the judicial system. We continue to work to end the repression completely and allow voting in the referendum. to resolve the political conflict and freedom,” he said. However, the President indicated that, in his opinion, more legislative changes should be made to achieve full decriminalization, which involves reforming the crime of embezzlement, which the ERC plans to address during the parliamentary process of criminal law reform. and through changes. Something that also directly negotiates with the PSOE.

ERC is not giving up on waste

Republicans have always defended a return to the PP’s pre-reform wording on criminal-type embezzlement, and voices from the government have left the door open for the issue to be debated throughout the parliamentary process. Today, President Pedro Sánchez avoided closing that door. “We’re going to see the parliamentary process,” he replied as he left the plenary session after being asked whether he intended to support changes to the embezzlement offence.

But the truth is that the climate has changed in recent weeks after criticism from a large part of the Socialists’ parliamentary partners, including a part of Unidas Podemos, which has even sparked an internal debate in the executive, because it is a crime that is clearly linked to the cases. About political corruption. Nevertheless, Moncloa has not yet revealed whether he will support the ERC’s intention on this matter in the parliamentary process, which the Republicans have not given up hope of yet. According to republican sources, negotiations on economic crime continue through discretionary channels.

The importance of the embezzlement reform for the ERC is of the utmost importance, as it depends on the judicial future of about thirty high-ranking officials and officials who are awaiting trial due to events related to the process. If the goal is de-justification, the crime of embezzlement is much more effective than sedition, although Republican voices suggest that it should be “surgical reform” to avoid unintended consequences. For this reason, and despite the complications of this crime, the Eskera take it for granted that they will introduce an embezzlement amendment and try to reach an agreement in the coming weeks.

PP’s excuse for blowing up bridges

The reform that is starting to be processed in the Congress today is primarily the abolition of the crime of sedition and the concretion of a new criminal type, aggravated public disorder. “The proposal envisages the homologation of the fines and the renaming of the species so that it goes to aggravated public disorder, as in other democracies with which Spain wants to be identified.” What the independence movement wants is amnesty, which this government is not going to accept,” explained Pedro Sánchez.

Despite criticism from the right, the penal code reform announced by the government does not mean the immediate rehabilitation of ERC leader Oriol Junqueras, nor does it speed up the eventual return of the former president of the Generalitat. , Carles Puigdemont. And here the crime of embezzlement plays a decisive role, for which the vice president is also convicted and for which Puigdemont is approved by the Spanish justice system.

In any case, this commitment by the government to the ERC to carry out the insurgency reform, a few weeks ago became the last burning nail for the PP to once again break off any type of negotiations with the government. At the last moment and after pressure from some popular territorial leaders such as Isabel Díaz Ayuso, Alberto Núñez Feijo ordered the blowing up of the bridges during the renewal of the General Council of the Judiciary, which was practically completed. “Someone lied to us in negotiations with the judiciary,” he argued.
