PSOE barons reject judges’ criticism and call for solution to ‘only yes is yes’ law
The Socialist Presidents of Aragon, Javier Lambán, Asturias, Adrián Barbón, Castilla La Mancha, Emiliano García Paige and the Presidents of Extremadura, led by Guillermo Fernández Vara, expressed this Thursday their desire for a solution to the law as soon as it is found. A comprehensive guarantee of sexual freedom, known as the “yes is only yes” law, is possible after several commutations and acquittals of sex offenders based on the use of the norm.
They also defended the work of judges and distanced themselves from criticism from Equality Minister Irene Montero, who accused judges of reducing sentences by interpreting the law.
From this point of view, Barboni advocated an “immediate” change in the norm. “When unintended and undesired results are achieved, it must be corrected immediately,” he noted. The President of Asturias does not doubt the good will of “passing the legislation” because, in his opinion, it is clear that the aim of the norm was not to reduce fines, “quite the opposite”. The law seeks to “unify the crime, be more severe and address the importance of guaranteeing people’s free consent,” Barboni says. “Now that the opposite has been achieved – albeit in a limited number of cases – it will be corrected as soon as possible,” he insisted.
As for the judges, Barbone said “it’s not about blaming them” but about “looking for a solution to the problem.”
Javier Lamban expressed himself along the same lines, calling for solutions to be found “as soon as possible” about the “holes” in the law. If there have already been some judges who have interpreted the norm that way, “it almost certainly means that the law offers loopholes that give rise to this type of interpretation,” he added, although he noted that he is not. to say whether the minister should resign or not.

For his part, Emiliano García Paige had harsher words for Minister Montero, considering that he shows “intellectual arrogance” for not admitting his mistake and regrets that he chose to “dig a ditch to prove himself”. . The state attorney general, Álvaro García Ortiz, assured this Thursday that the prosecutor’s office will review the sentences affected by the new law “only yes is yes” and that it will do so “to avoid automaticity” and “with a clear priority and call for the protection of victims.” He also recalled that “the types of crimes have been modified and this implies a revision of some of the existing punishments.”
