The PSOE defends sedition reform so that “there are no more havens for attacks on public order”.

PSOE parliamentary speaker Patxi Lopez explained this Friday some of the details of the organic law proposal that her group will register with United We Can to reform the crime of sedition and thus “Europeanize” it under the criminal code. words. The aim, as stated in a press conference in Congress before the initiative was registered, is to prevent those who do this from staying in European countries, as happened, for example, with Carles Puigdemont. “With this reform, which will not be repeated again, there will be no more shelters for attacks on public order,” assured the Basque MP.

López explained that the insurgency reform is part of a wider legislative package “to adapt criminal law to the EU order” and “to reform crimes against moral integrity, public disorder and the smuggling of dual-use weapons”. The spokesperson explained that the amendments serve to adapt “European Union directives” on “combating fraud, falsification of non-cash means of payment”, as well as “criminal sanctions for market abuse”. Also to “provide competition authorities with the means to apply the rules and ensure a fair internal market”.

Similarly, the amendment to the Criminal Code will serve to “conceal the body against the moral integrity” of the young woman in the murder case and thus be able to determine exactly what happened. In addition, the offenses of “defense material and dual-use technology smuggling” have been corrected.

imprisonment for up to eight years and disqualification

But the most important part of the reform is the rebellion, which will disappear as such in order to, according to López, “harmonize” the crime with “neighboring countries”, as well as “adjust its regulations to the current historical reality”, which is. “Very different from the period when the types were conceived. And finally, it will allow “clarification of the structure of the affected criminal types”, he said.

The idea is to “introduce a new regulation of the crime of public disorder, which makes it clear what are the final elements of its commission,” Lopez said. Namely: “group action, attack on public peace and existence of violence or intimidation”.

“An aggravated modality of disorder has been introduced, requiring that they be committed by people whose characteristics are suitable for affecting this public order, and aggravating circumstances will also be systematized,” he continued. Thus, according to him, “those who act with violence or intimidation, or in a crowd that can disturb public order or prevent the application of laws or administrative and judicial decisions, will be punished.”

In this case, he concluded, “the penalty would be imprisonment for three to five years and disqualification at the same time.” And if these crimes are committed by a public authority, the penalty of disqualification will be “absolute” and the penalty will be between six and eight years.

A PSOE spokesman recalled that “since there was no crime of sedition” in other European countries, “judicial cooperation was not possible” after 1-O and the escape of several people involved in the unilateral declaration of independence, such as former president Carles Puigdemont. , “because an equivalent type was required that did not exist,” which “prevented extraditions.”

What he promised “will not happen again with this reform”. “There will be no more shelters for attacks against public order,” he assured.

Puigdemont will be “judged”

López assured that the reform has been agreed not only with the ERC, but also with other parliamentary groups and that the government believes it already has a sufficient majority to implement the changes, which, as an organic law, require an absolute majority. of deputies and senators.
