The government will use the law of democratic memory against two high-ranking Aragonese officials for promoting Francoism.

The image of Esmeralda Pastor posing smiling in front of a Francoist flag took less than two days to explode in front of Aragon’s brand new government. The executive of Jorge Azcon (PP), invested with the votes of Vox and the Aragonese Party (PAR), named 26 senior officials last Thursday. Among them, the new Director General of Justice, who appeared on his Facebook profile with pre-constitutional insignia, was later conveniently cropped so that only part of him was visible.

This Saturday, both Podemos and the Socialist Party asked the Aragonese president to remove him “suddenly” after messages from another regional official, Jorge María Valero, director general of hunting and fishing at the Ministry of Agriculture. came out , posted on the same social network, commemorating the birth of José Milan Astra, the founder of the Legion and a figure corresponding to the coup d’état and the regime of Francisco Franco. Now the Secretary of State for Democratic Memory goes even further and initiates procedures to open disciplinary proceedings for violations of the Democratic Memory Act.

Based on Article 62.1 of the Memory Law approved in October 2022, this sanction can lead to a fine of between 10,001 and 150,000 euros for a serious crime like this. Sources in the Ministry of the Presidency, Relations with the Courts and the Ministry of Democratic Memory say they are “very vigilant” and assure that they will act against any act of promoting Francoism, or against any behavior against the law: “We are not going. Even if he passes one.”

Due to the controversy, Esmeralda Pastor deleted or made the posts private, although several parties saved examples of the types of content she shared. For example, a Facebook post titled “¡Viva Franco y Arriba España!” in which he glorifies the figure of the dictator. A similar thing happens with Valero, who in his publications justifies the figure of Milan Astra and spreads calls for demonstrations in favor of preserving his street name, a change also required by the law of memory.

In particular, Article 62 refers to “non-acceptance of necessary measures to prevent or end sales in spaces open to the public.” […] On the actions of personal or collective aggrandizement, military rebellion, war or dictatorship, its leaders, participants of the repressive system or organizations supporting the dictatorial regime, when it causes discredit, contempt or humiliation of the victims or their relatives. “. And it also refers to “acts, communication or advertising campaigns” in “any medium of public communication” that pursue the same objectives.
