The government obliges the industries that receive the aid to maintain their activities for at least five years

The Council of Ministers approved this Monday a new industry law project, the first in 30 years, which aims to strengthen the role of this activity in the Spanish economy in the midst of a green and digital transition. The measure envisaged in the recovery plan “strengthens industrial strategic sovereignty” and seeks to improve the competitiveness of this activity in the international arena, according to the Ministry of Industry.

One of the main innovations included in the text is that it “protects industrial employment”, according to Reyes Marotto’s department, and “protects our industrial capacity”, as the minister explained in a press conference after the Council of Ministers. that companies receiving state aid for industry must maintain productive activity for at least five years. In the case of small and medium-sized businesses, the term is reduced to three years. The new law stipulates that the General State Administration will promote and develop lines of assistance that will promote modernization, development and industrial competitiveness.

The standard addresses aspects such as industrial promotion and improvement of its competitiveness, reindustrialization, industrial digitalization, industry adaptation to climate neutrality, industrial strategic autonomy, promotion of industrial ecosystems and projects of common interest, safety and industrial quality and governance. .

It replaces the 1992 law and aims to promote an activity that has gained weight in the European agenda in recent years, with the experience of great restrictions and the deglobalization of many industrial activities. The main tasks of the law are to guarantee the freedom of establishment of industry and the unity of the market in this activity, to protect the free circulation of industrial products, to promote a favorable environment for the formation of industrial ecosystems, and to promote “tractor projects”. general interest”, as well as strategic planning of industrial activities, “protecting the industrial base that supplies basic needs and strategic resources”.

The text provides an index of refinancing loans to facilitate repayment of loans granted to companies in national state aid programs. And in the conditions of an industrial crisis, the obligation of the company is established, under certain circumstances, to expect the closure or reduction of activities, which implies a significant reduction of employment, formulas must be investigated to avoid, reduce or mitigate its consequences. . For this, reindustrialization tables will be created in the presence of the state, so that the agents involved can find a solution within a specific time.

The text, which defines “strategic” industries, introduces new industrial security obligations so that in the event of a serious and imminent risk, the administration agrees to temporarily, fully or partially suspend the facility. The mode of infringement is also detailed, with fines of up to 100 million euros being the most serious.

To strengthen “the governing structures of the Spanish industrial ecosystem”, a State Council for Industrial Policy will be created as a consultative, consultative and collaborative body on issues affecting industry “to promote its growth, resilience and competitiveness”. Spain’s strategy for industrialization 2030 will also be developed. along the general lines of industrial policy. and a state plan for industrial momentum.

The new law seeks to develop and support industrial ecosystems as poles of industrial development, especially those considered strategic. And it regulates industrial projects of common interest for the first time. They must meet at least two of these three conditions: undertake investment volume or undefined “significant” employment; belong to defined industrial ecosystems or be part of sectors considered strategic by the National Security Council; o Be consistent with EU industrial goals and integrate into European funding mechanisms.

The draft, which is the result of a public consultation process opened last spring, recognizes special protection for energy-intensive industry with accompanying measures to promote its decarbonisation. Pay special attention to the internationalization programs of Spanish companies. And it envisions the possibility of launching regulatory test beds for pilot projects that encourage research and innovation.

In addition, public administrations within their competence will promote and implement measures that contribute to the provision of services and infrastructure necessary for the development of industrial zones. Promotion of industrial land should preferably be carried out on the basis of consensus with the actors involved in its development and management.
